Is Alimony a Part of Every Divorce?

Every divorce involves the legal separation of two people’s lives, but does every divorce include alimony payments? Well, if you don’t know the answer, you’ve come to the right place!

Each individuals earning potential is not the only factor in determining if a divorcee must pay alimony.

Other factors judges consider when determining potential alimony payments include:

  • The length of the marriage;
  • The ability of a spouse to pay alimony;
  • The need of a spouse for alimony;
  • Marital misconduct (infidelity, abandonment, drug habits, etc.); and
  • Each spouse’s contributions to the other spouse’s education or career.

As you can see, there are no guarantees alimony will be a part of the divorce process. Many factors can impact potential alimony payments, but you should never assume that you will have to pay or receive alimony.
